TERMS AND CONDITIONS
1. GENERAL
These Terms and Conditions ("Terms and Conditions") apply when you, as a private individual, make a purchase on Flexited and related websites ("the Website").
2. ORDERING AND AGREEMENT
You accept these Terms and Conditions when you place your order on the Website or, in certain cases, via phone or email through our customer service. To complete a purchase, the total order amount must be at least DKK 50. You must also be over 16 years old and have the legal right to enter into an agreement according to applicable law, such as not being under guardianship.
When you complete your purchase, we automatically send a confirmation that we have received your order. However, a binding agreement is only formed when we send a delivery confirmation to the email address you provided at the time of purchase.
We may need to reject an order if you have provided incorrect information at checkout, if we suspect fraud, or if the order cannot be completed because the product is out of stock. In such cases, we will notify you as soon as possible.
3. PERSONAL INFORMATION
BARTELS KØBENHAVN is responsible for personal data and the processing of your personal information when you visit the Website and make a purchase from us. 4. PRICES AND PRODUCT INFORMATION
The price of goods on the Website is stated including VAT. BARTELS KØBENHAVN uses rounding to whole kroner in connection with payment. Prices do not include payment and shipping fees. Fees for shipping and payment are added separately unless otherwise clearly stated on the Website.
We always strive to display our products as accurately as possible. This includes, for example, color reproduction or measurements. All image information should be viewed as illustrations, and we cannot guarantee that they accurately represent the exact appearance of the products. Color reproduction may vary depending on your device or screen. The measurements shown on clothing at BARTELS KØBENHAVN are approximate and provide guidelines on which size fits you best.
If there are errors in the price or information about a product listed on the Website, and you have realized or should have realized it, the price or information will not apply to the purchase. In such cases, we will contact you as soon as possible.
5. PAYMENT
You can pay for your purchase at BARTELS KØBENHAVN using the following payment methods.
Card Payment
BARTELS KØBENHAVN uses a payment intermediary provided by Avarda. Avarda is responsible for full security when you use their payment service. During the purchase, the information is encrypted so that no unauthorized person can access it. You can pay with Visa and Mastercard. BARTELS KØBENHAVN does not charge any additional fees when you use this payment method. Our price guarantee applies to deliveries in Denmark when paying by credit card. A check is conducted to ensure that the card information matches and that there is coverage for the purchase.
When you pay by credit card, the money is withdrawn immediately after you complete your order. If you are awaiting a refund, it can take 2-5 business days for a refund to be made to your payment card after the case is concluded with BARTELS KØBENHAVN. This allows all parties, including the bank, to complete the transaction.
PayPal
When you choose the PayPal payment method at checkout, the payment is made directly via PayPal. Once the incoming payment has been received by BARTELS KØBENHAVN, the delivery is sent to you. Jonna Jensen does not charge any additional fees when you use this payment method. Please note that you are not covered by the dispute resolution scheme with this payment method.
6. DISCOUNTS AND OFFERS
To use a discount code, you must log in to your account at BARTELS KØBENHAVN. Note that discount codes must be entered exactly as they are shown. The price is adjusted according to the discount linked to the specific discount code. The validity period and terms are specified in connection with the discount code. The discount applies to a single purchase and cannot be transferred to exchanges or future orders. This also applies to temporary offers, where the price is only valid for a certain period or day. If the discount is not correctly applied to your purchase, please contact us before completing your order. It is not possible to combine different discount codes with each other or in connection with the use of gift cards.
7. DELIVERY
Your order is delivered to you with the delivery option you choose at checkout. You pay a fee depending on the delivery option you choose. You can find information about your options on the Website and at checkout. You can always find updated information about the delivery options we offer here.
Delivery Time
The expected delivery time is stated on the Website and in the delivery confirmation and may vary depending on the delivery option you choose. We usually deliver within 7-12 working days from the time you placed your order. We always strive to deliver your order within the estimated number of working days for delivery indicated on the Website and in your delivery confirmation. Note that the delivery time may vary depending on where you live, the delivery option you choose, and the time of the season when you place your order.
Delivery Method
When your order is shipped from our warehouse, you will receive a delivery confirmation with complete information where you can track your order. Depending on the size of the package, it is sent either as a letter or a parcel. A letter is delivered, if possible, first to your mailbox, otherwise to the nearest pickup point. Parcels are sent directly to the pickup point, where they are held for 14 days. You will always receive an email, notification, or SMS with information about your order. For delivery methods that require ID, please present valid identification when picking up the package. Note that there may be some deviations depending on where you live. Unclaimed Package
If you have not collected your package within the specified days it is held at the pickup point, we will charge a fee. The fee covers the costs incurred in connection with your purchase, currently DKK 50. If you wish to exercise your right of withdrawal, please inform us first, as an unclaimed package is not considered the use of the right of withdrawal.
8. FAIR USE POLICY
Our Fair Use Policy is established for environmental reasons and to enable us to continue offering competitive prices and services to our customers. Since a very small number of customers order and return remarkably large quantities of goods, we have established a policy where we reserve the right to deny these customers the right to enter into further agreements with us. We may therefore need to close your account and/or limit your payment methods with us if we become aware of a systematically deviant purchasing behavior: for example, by buying and returning large quantities of goods where there is reason to suspect that the order was not placed with a genuine intention to complete the purchase, or if there is suspicion of misuse in connection with returns. As in other cases, a binding agreement is only formed when we send a delivery confirmation to the email address you provided at the time of purchase. The policy only prevents you from entering into a new agreement with us and does not affect your rights in connection with already binding purchases.
9. ABOUT THESE TERMS AND CONDITIONS
These Terms and Conditions shall be interpreted and adapted in accordance with Danish law. We have the right to change these Terms and Conditions, but the Terms and Conditions you approved at the time of your purchase always apply to that purchase. All changes will appear in the most recently published version of the Terms and Conditions on the Website. The changes take effect from the time you accept the Terms and Conditions, that is, when you complete a new purchase on the Website.
10. CHOICE OF LAW
When you complete your purchase, an invoice statement including 'BARTELS KØBENHAVN' and the country code such as 'HK', 'Ireland', etc., will be displayed on the payment page and/or your card statement. All purchases will be processed by our respective entity in the corresponding country as indicated by the country code in the invoice summary and are subject to local law.
